McDonalds Kerb Ripped my Front Bumper off

Guest-only advertisement. Register or Log In now!
    So here goes the story.

I pulled into a parking spot to drink a quick cup of coffee before a meeting. I had very little sleep and a long week of work.

I reverse out to hear a great did clunk. Get out and find that the mc donalds kerb and ripped off my front bumper, fogs destroyed and grill area bent up. I had a foreman in the next parking space, luckily he had a jack, which meant that I could raise the car to pull the bumper back. He told me that some plonker built the parking lot wrong. There's a line on the brick which is supposed to indicate where the tarmac level should be. The tarmac is a good two-three inches below where it should be.

Bad news is that my broker and underwriter are refusing to help. 1) because there is no third party 2) my compulsory excess is 3 grand, my car is worth 2.6 grand.

I've got Mcdonalds insurance details and have contacted them. Will be submitting a claim to see if they want to reasonably settle this and repair my car.

I'm willing to accept resonsibility if it is my fault, but this kerb seems very odd.

Did something similar to this, only ripped the valance off and not the whole bumper. I now park like two feet away from the curb.

Yep. Did the same thing back in 2004. Was able to repair the valance and still have the same one today.

Possibly not. We have building regulations in the UK, especially for public car parks. It has to be built to specs. A ferrari or Lambo would be damaged by these kerbs.

At least I can get my headlights out for a polish inside now lol

Also eyeing this up incase its goes south. Requires some modifying with parts of the old bumper needing to be bonded together.

So when you rear end someone parked in front of you in a parking lot, it's somehow their fault if they parked too far back in their space? Take responsibility for your mistake and move on.

And the title of your post is wrong. You ripped off your bumper, not McDonald's.

I believe what Arnie is saying is that there are standard curb height regulations in the UK. If these regulations are not followed there could be some liability for McDonald's.

I dont think that analogy quite works in this case.

Tarmac has to be set at a certain height. Otherwise there would be significant damages to vehicles on parking, our spaces aren't huge and overhanging is very common.

As I said, I had a foreman parked next to me, who was actually working on the ground plans for a KFC and Costa out of London. If it is the case that the tarmac was supposed to be up to the watermark line in the photo's then I can't see how I am liable. It looks like the kerb has seen some previous conflicts.. (Which would of avoided this accident)

I back into stalls exclusively. I find it easier to avoid damage as you can use your mirrors. Forward you are parking by braile. Bonus is it makes for quick getaways, and due to the fact we run no front plate here, stealth.

Too bad this wasn't a US McDonalds car park as you would have a better chance at restitution. Stella Liebeck got ~$460K out of them for being burned by their coffee. Think of how many bumpers that would buy! As a colonial subject of the Queen, I hope your laws are more favourable than ours...

I couldn't back into this. The car park has like 12 spaces, accessible from only one direction. This is the 2nd space to the end and there were cars in all spaces on the opposite side. I would of needed at least 1 more space to reverse parallel park.

Fair enough. I forget stuff is tighter out your way. We have nothing but space where I live. Petro based city means four lane roads everywhere and monster car parks...

yeaa definately driver fault. i got at my gf when we first got together because she always drives up to the curb/parking blocks when its not even needed and wondered why the front of her bumper looked like shit on the bottom. fixed that and she fixed her driving. car looks new. if its a small spot (like in my complex) i back in. the rears of these cars arent as low. and either way they are pretty small.

yet somehow a truck, with longer wheelbase and larger turning radius, has managed to back in to the space next to you?

You pulled up too far in the space. Its a pretty common occurrence. I did it once in my college parking lot. Luckily however I was able to pop it back into place and be on my way. In the same lot a buddy with a B7 did the same thing, and it caused some pretty significant damage, but now where near the amount of yours.

3 grand for a bumper, grille, and fogs seems a bit steep. You can source those from a parts car or breaker yard for a few hundred dollars.

If you're not 2 feet back from any curb or parking pylon, you're too close.

You lost that bumper because you were silly enough to pull the nose end of your car over top of a curb. McDonalds is not at fault, and you won't see a dime from them.

I still don't know why people park their cars with anything over those. Even with sidewalks, blocking portions designed for pedestrians.

I never park my bumper above those. Only did it once by accident (slightly over it...but that was enough) at Chipotle at h2o, but only because the spots are silly small and I did not want my rear sticking out. Paid the price. Ripped my bumper off the passenger side clip and rode that weekend with a dumb sagging bumper. Bumper now is held on by quick latch.

Knowing British kerbs that does look like the tarmac or block paving should level with the lower angle change, but due to gradient changes in car parks etc they'll probably say is within tolerance. Worth a try pursueing!

You fool, trying to get McDonalds to pay for your dumbass mistake. Own up to it; this is what's wrong with people these days.

Nothing odd about that curb, maybe it's the lowered car, no under cover and dummy at the wheel.

I'm not sure what you guys have such a problem with. If there are regulations in the UK that specify maximum curb height, and this area doesn't meet that regulation, the parking lot owner is responsible. It is the same in the US if something doesn't meet the code. You can bet that if the insurance company was involved they'd be doing the same thing.

In any case, you should have heard something when pulling in as it looks like you were a good 3-4 inches (6-8 cm) over the curb. I can hear when I even start to touch a curb out parking bumper and stop immediately and back up a little. Just need to be more careful in the future.

There's nothing on the other side of the kerb. It's a good 2-3 inch drop until it reaches pebbles. My bumper would of easily gone over and then caught on the edge of the kerb on the other side, which is what happened.

Had it of been tarmac'd on the pavement, the bumper wouldn't of had anything to catch on.

I don't really see how I drove my bumper 'into the kerb'.#

I guess you don't get compensation when there's potholes in your local area and your wheels and rims get shredded to pieces? We do over here, it's each council's (areas) responsibility. You send them a picture and they pay damages with no questions asked. There are potholes everywhere over here.

McDonald's doesn't pave parking lots, they make shitty food. You'll be redirected to the general contractor, who will redirect you to the paving contractor who is probably some cash strapped guy trying to pound out a living paving fucking parking lots. You fucked your bumper up......pull in a little farther next time and see if you can hole the oil pan, or bend a wheel.

Just so you know guys.. if a deficiency was and is found it is the responsibility does lie with the owner/ proprietor of said property.
Case and point : I slipped and fell on a curbstone thay had been painted the proper color, but not a none slip paint resulting in a torn labrum and rotator cuff.. liability was found to be the owner of the store who in turn could sue the contractor for shoddy workmanship. Either way a case could be made in a court of law and possibly a 50/50 liability. There is no need to bash the guy when he's down. If the contractor did not put down the required thickness they can be held liable.

I had my tire popped by a pot hole on a parking lot as well. I called the property owner to try and make them pay and the guy was a douche. I was lucky that the person I bought the wheels from gave me a brand new spare tire so I just had to pay to have it installed. Wasn't worth the hassle to pursue so I let it be but they did end up fixing the pot hole.

Damn, that sucks but why would you even drive into the space so deep? I would never risk going that deep even though I'm stock height now for exactly this reason. Hopefully you can get something done but hoping for McDonalds to fix your car is a stretch here in the states.. Not sure about the UK though. Seems like a dandy place to be when there's car damages though. Haha
